Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Starlightweave Labs ("Company," "we," "us," or "our") governing your access to and use of Aetherweave Gambit and all related services, websites, and applications (collectively, the "Service").

By creating an account, accessing, or using the Service, you confirm that:

• You have read, understood, and agree to these Terms;
• You agree to our Privacy Policy and Cookie Policy;
• You agree to the End User License Agreement (EULA);
• You meet the eligibility requirements set forth below.

If you do not agree to these Terms, you must not access or use the Service.

2. Eligibility

To use the Service, you must:

• Be at least 16 years of age, or the age of digital consent in your jurisdiction;
• If you are between 16 and 18 years of age (or the age of majority in your jurisdiction), have your parent or legal guardian's permission to use the Service;
• Have the legal capacity to enter into a binding contract;
• Not be barred from receiving the Service under applicable law.

By using the Service, you represent and warrant that you meet all eligibility requirements. We may require verification of your age or identity at any time.

3. Account Registration

3.1 Account Creation

To access certain features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information;
• Maintain and promptly update your account information;
• Maintain the security and confidentiality of your login credentials;
• Accept responsibility for all activities under your account.

3.2 Account Security

We provide two-factor authentication (2FA) to enhance account security. We strongly recommend enabling 2FA. You are solely responsible for:

• Keeping your password confidential;
• Any activity that occurs under your account;
• Notifying us immediately of any unauthorized use.

3.3 One Account Per Person

Each person may maintain only one active account. Creating multiple accounts may result in termination of all accounts. Account sharing is prohibited.

4. User Conduct

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable laws, regulations, or third-party rights;
• Use the Service for any fraudulent or illegal purpose;
• Harass, bully, threaten, or intimidate other users;
• Post or transmit content that is defamatory, obscene, hateful, or discriminatory;
• Impersonate any person or entity;
• Attempt to gain unauthorized access to any part of the Service;
• Interfere with or disrupt the Service or servers;
• Use automated systems, bots, or scripts without authorization;
• Exploit bugs or engage in cheating or hacking;
• Engage in real-money trading of accounts or in-game items;
• Spam, advertise, or solicit other users;
• Collect or harvest user data without consent.

5. Intellectual Property

5.1 Our Intellectual Property

The Service and all content, features, and functionality thereof are owned by Starlightweave Labs and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Protected elements include but are not limited to:

• The Aetherweave Gambit name, logo, and brand identity;
• Game mechanics, systems, and designs;
• All artwork, graphics, animations, and visual elements;
• Music, sound effects, and audio compositions;
• Characters, stories, lore, and narrative content;
• Faction names, "Ego Sword" designs, and unique game concepts;
• Software code and technical implementations.

5.2 User Content

You retain ownership of original content you create. However, by posting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, and display such content in connection with the Service.

6. Virtual Items and Currency

The Service may include virtual items, currency, or other digital goods ("Virtual Items"). You acknowledge and agree that:

• Virtual Items are licensed, not sold, to you;
• Virtual Items have no real-world monetary value;
• Virtual Items cannot be exchanged for real money or items of value;
• We may modify or remove Virtual Items at any time;
• Virtual Items may be lost upon account termination;
• No refunds will be provided for Virtual Items.

7. Community Guidelines

Our community is built on principles of respect, fair play, and good sportsmanship. Users are expected to:

• Treat all players with respect and dignity;
• Play fairly and within the spirit of the game;
• Report bugs and exploits rather than abusing them;
• Contribute positively to the community;
• Follow moderator instructions and decisions.

Violations of Community Guidelines may result in warnings, temporary suspensions, or permanent bans at our sole discretion.

8. Third-Party Services

The Service may contain links to or integrate with third-party websites, services, or content. We are not responsible for:

• The availability, content, or practices of third-party services;
• Any loss or damage arising from your use of third-party services;
• The privacy practices of third-party services.

Your use of third-party services is governed by their respective terms and policies.

9. Service Modifications

We reserve the right to:

• Modify, update, or discontinue any part of the Service at any time;
• Change game mechanics, features, or content;
• Perform maintenance that may temporarily interrupt service;
• Modify these Terms with notice to users.

We will endeavor to provide reasonable notice of significant changes. Continued use of the Service after changes constitutes acceptance of the modified Terms.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND;
• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED;
• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES;
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

Some jurisdictions do not allow limitation of certain warranties or liabilities, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Starlightweave Labs and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

• Your use of the Service;
• Your violation of these Terms;
• Your violation of any third-party rights;
• Your User Content.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination:

• Your right to use the Service will immediately cease;
• Your account and associated data may be deleted;
• Any Virtual Items or progress will be forfeited;
• No refunds will be provided.

You may request account deletion at any time by contacting us. See our Privacy Policy for data deletion procedures.

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved as follows:

• First, attempt to resolve the dispute informally by contacting us;
• If informal resolution fails, disputes shall be resolved through binding arbitration;
• Class action lawsuits and class arbitrations are waived to the extent permitted by law.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our EULA, Privacy Policy, and Cookie Policy, constitute the entire agreement between you and Starlightweave Labs regarding the Service.

14.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of that provision.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

14.5 Governing Law

These Terms shall be governed by the laws of the European Union and the applicable laws of the jurisdiction in which Starlightweave Labs is registered.
